Refund and Cancellation Policy

This page summarizes the refund, cancellation, and right of withdrawal policy for the Bai service. The detailed and binding provisions are in Terms of Service §13; in case of conflict, the Terms prevail. If your jurisdiction recognizes mandatory consumer rights, those always take precedence over what is described here.

1. Free Trial Period

  • 9 days free to try the service with no commitment.
  • No charges are made during the trial period.
  • You can cancel at any time during the trial at no cost.
  • No credit card required to start the trial.

2. Subscription Cancellation (Bai Go)

You can cancel your Bai Go subscription at any time, without penalties:

  • Customer Portal: in your workspace, go to Settings → Billing and open the Stripe portal (recommended).
  • Via WhatsApp: write "cancel subscription" to your Bai assistant.
  • Via email: hey@baios.ai with your account email.

When you cancel, your access to the service continues until the end of the current billing period. There are no additional charges or penalties. Cancellation does not generate a prorated refund of the current period, except as provided in section 4 below and in Terms §13.5.

3. Right of Withdrawal

If you reside in a jurisdiction that recognizes a right of withdrawal, you can exercise it within the corresponding legal period. These rights are mandatory: they prevail over any other clause of this policy or of the Terms.

  • European Union: 14 days from the contract conclusion (Directive 2011/83/EU). If you expressly request the immediate start of the service within that period, you must pay the proportional part of the service effectively rendered.
  • Colombia: 5 business days for withdrawal in distance contracts (Consumer Statute, Law 1480 of 2011, art. 47).
  • Mexico: the period established by the Federal Consumer Protection Law for distance contracts.
  • Other jurisdictions: the period applicable under local regulations.

To exercise the right of withdrawal, write to hey@baios.ai within the applicable legal period with your account email. More detail in Terms §13.4.

4. Refund Policy

4.1 Bai Go — 7-day courtesy on first payment

As an additional courtesy beyond the legal right of withdrawal, we offer a full refund if you request it within 7 days after your first Bai Go subscription payment. This courtesy:

  • Applies only to the first payment of the subscription (not to subsequent renewals).
  • Is voluntary on the Company's part and does not replace the mandatory rights described in section 3.
  • We process requests within 5–10 business days via the original payment method.

4.2 Go Founder ($299 USD, one-time payment) — Waiver of withdrawal

The Go Founder plan is a one-time payment of USD $299 that grants lifetime access to the Bai Go features in effect at the date of purchase (see Terms §13.9). As a digital service with immediate access:

  • Before checkout, the user must expressly consent to the immediate start of the service and acknowledge that this implies the waiver of the right of withdrawal over digital content once its provision has begun, in accordance with the exception in EU Directive 2011/83/EU art. 16(m) and equivalent rules.
  • This waiver does not affect mandatory rights recognized by your jurisdiction in cases of material defects or non-conforming performance.
  • The Founder plan is non-transferable and, once immediate performance is consented, does not admit refund for withdrawal, except as provided in section 5 (material defects) and in Terms §13.5.

4.3 After the Courtesy or Withdrawal Period

  • After the 7-day courtesy (Bai Go) or after consenting to immediate performance (Go Founder), payments are non-refundable, except as provided in section 5 and in Terms §13.5.
  • When canceling Bai Go, you keep access until the end of the billed period.
  • There are no future charges once the subscription is canceled.

5. Special Circumstances

In accordance with Terms §13.5, we evaluate proportional refunds case by case when:

  • The service has sustained material failures not attributable to the user.
  • Duplicate charges occur or other extraordinary circumstances of the payment provider.
  • The mandatory regulations applicable in your jurisdiction recognize a right to a refund.

No refunds are granted in case of account termination for breach of section 12 (Fair Use of the Service) or section 9 (Acceptable Use) of the Terms.

6. What Happens When You Cancel

  • Access: continues until the end of the billed period (Bai Go) or remains for life (Go Founder, except for service discontinuation per §13.9).
  • Data: retained for 30 days in case you decide to return.
  • Automatic deletion: after 30 days, your data is permanently deleted.
  • Immediate deletion: you can request it by contacting us. More detail in the Privacy Policy.

7. How to Request a Refund

For any refund request or to exercise the right of withdrawal:

  • Response time: 24–48 business hours.
  • Refund processing: 5–10 business days via the original payment method.

8. Plan Changes

If you switch between Bai Go monthly and yearly, changes are prorated based on the remaining time. The Go Founder plan does not admit changes (it is for life over the original Founder Features). New features launched later may have a separate cost without affecting the original access (§13.9).

9. Price Lock for Active Subscriptions

Bai Go subscribers keep the price in effect at the time of subscription as long as the subscription remains active and uninterrupted, per Terms §13.10. If you cancel and reactivate later, the public price in effect at that time will apply.
